1. Acceptance of Terms

By downloading, installing, or using the TrainRX mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

TrainRX is a fitness and workout tracking application that allows users to create workout templates, log training sessions, track body measurements, store progress photos, monitor personal records, and integrate with Apple HealthKit (iOS). The App is available in free and premium subscription tiers.

3. Account Registration

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account.
• You must be at least 13 years of age to use the App.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate and complete information when creating your account.

4. Subscriptions and Payments

4.1 Free Tier

The App offers a free tier with limited features, including a maximum number of workout templates, sessions, and measurements as defined within the App.

4.2 Premium Subscription

• TrainRX Premium is available as an auto-renewable subscription through the Apple App Store.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions in your Apple ID account settings.
• Refunds are handled by Apple in accordance with their refund policies.

5. User Content

5.1 Your Content

You retain all rights to the content you create and upload to the App, including workout data, measurements, progress photos, and any other personal data ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing and improving the service.

5.2 Content Guidelines

You agree not to upload content that:

• Is illegal, harmful, threatening, abusive, or otherwise objectionable.
• Infringes on the intellectual property rights of any third party.
• Contains viruses, malware, or any other harmful code.
• Violates any applicable laws or regulations.

5.3 Content Rights

TrainRX does not claim ownership of any User Content. All workout data, progress photos, body measurements, and personal records you create within the App remain your property. We do not use your content for advertising, marketing, or any purpose other than providing the service to you. You may request export or deletion of your content at any time.

6. Intellectual Property

The App, including its design, features, code, graphics, logos, and all related intellectual property, is owned by TrainRX and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the App, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the App.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use automated systems or bots to access the App without our permission.
• Share your account credentials with third parties.

8. Health Disclaimer

TrainRX is a fitness tracking tool and does not provide medical advice. The App is not intended to diagnose, treat, cure, or prevent any disease or health condition. Always consult a qualified healthcare professional before starting any new exercise program or making changes to your fitness routine. You use the App and perform any exercises at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, TrainRX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury arising from your use of the App. Our total liability for any claims arising from your use of the App shall not exceed the amount you have paid for the subscription in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or secure.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time by contacting us. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.
